Builder delaying possession/registration of flat in Evelina, Hiranandani Estate
Hiranandani builder committed possession of flat in this building by September - October 2007. Building was ready by that time but till now we have not recieved possession. We have made number of calls and e mails and builder giving new time lines month after month. Latest they told us that possession of flats up to 19th floor is granted but still awaiting clearance for higher floors. We have made 97% payment to builder in advance and now there is significant delay in possession and we are incurring financial loss. Please suggest a suitbale solution.

In case of delay, the builder is liable to refund the amount paid with interest (for the period of delay), please check your contract if there is any clause or force majeure mentioned. You immediately move a Consumer Complaint before the Consumer Court alongwith an Interim application, seeking a stay against builder and get verified it from a lawyer. I suggest consult a lawyer, issue a legal notice to the builder before making complaint and wait and see if things work out.
